Pre-Filing Credit Counseling
In order to file bankruptcy, you must complete credit counseling prior to the case being submitted to the Court. The course must be completed within the 6 months before filing, but at least 24 hours prior to us filing your case. We cannot file a case when the credit counseling was completed the same day. You CANNOT file your case without a credit counseling certificate.
The pre-bankruptcy counseling will include an evaluation of your personal financial situation, a discussion of alternative to bankruptcy and a personal budget plan. This course can be completed in person, by telephone or online. The Gaschler Law Firm LLC includes the $49.00 fee for this service in your Fee Agreement, you do not have to pay for this service.
Our preferred provider for Credit Counseling is Hummingbird Credit Counseling.
Post-Filing Financial Education
The post-bankruptcy education course will include information on developing a budget, managing money, using credit wisely and other resources. This course can be completed in person, by telephone or online. The Gaschler Law Firm has a list of approved providers for each of these areas that you may use. A typical counseling session should last about two hours. Each person that has filed for bankruptcy must complete the course and obtain there own certificate. The Gaschler Law Firm includes the $19.00 per person fee for this service in your Fee Agreement, you do not have to pay for this service.
If you have filed a Chapter 7 case, this certificate will need to be filed with the Court 30 days after filing. A discharge will not enter for your case until this course is completed. Failure to complete this course can result in your case being closed without a discharge.

In 2005 The Bankruptcy Abuse Prevention and Consumer Protection Act required that all people who plan to file for bankruptcy protection must get credit counseling from a government approved organization. Additionally, all bankruptcy filers are also required to complete a financial education course after their cases are filed.
